1. Domain licences and customer authority
A domain is licensed under the rules of the relevant registry; it is not purchased as property. You authorise Tomedia to act as reseller or technical agent for the requested registration and management steps. Registry, registrar and dispute rules form part of the service and prevail where they must. You must provide complete, true and current registrant, eligibility and contact information and keep it current. For .au names, the registrant must meet and continue to meet the applicable Australian presence, namespace eligibility and allocation rules throughout the licence period. Loss of eligibility or inaccurate information can lead to suspension or cancellation by the registry or registrar.
2. Searches, quotes and registration
A search or quote does not reserve a domain. Availability, premium status, eligibility and price are rechecked before submission. Registration is complete only when confirmed by the registry or registrar. You must verify spelling, registrant identity, contact details and licence period before approval. We may refuse or pause an order that lacks required information, fails validation, creates a legal or security risk or cannot be supplied on the quoted basis. If no supplier transaction is committed, the applicable uncommitted payment will be reversed or refunded.
3. Renewal, expiry, restoration and transfer
Renewal dates and reminders are administrative aids; you remain responsible for maintaining current contact and payment details and giving instructions in time. Auto-renew operates only where shown as enabled and payment succeeds. Registry deadlines, grace periods, redemption fees and deletion timing vary. We cannot guarantee recovery after expiry. Transfers require the registrant's authority and compliance with registry rules. You must not use a transfer to evade a dispute, debt or lawful restriction. We will provide an authorisation code or transfer assistance to the verified registrant where required and lawful, subject to reasonable security checks.
4. DNS, nameservers and certificates
DNS changes affect website, email, verification and other services. We will act only within the authority and management mode recorded for the domain. You must review proposed record or nameserver changes and identify critical services. DNS propagation, resolver caches and external authoritative providers can delay or vary results. Certificates depend on domain control, supported hostnames and provider validation. A certificate or provider status alone does not prove that the correct website is safely routed. Activation may require agreement between DNS, certificate, hostname and origin checks.
5. Hosting, resources and backups
Hosting plans include the resources and support stated in the order. You must keep applications and credentials secure, use supported software and stay within reasonable storage, traffic, email and compute limits. We may apply proportionate controls where use threatens service integrity. Unless a written order states a customer-managed backup service and retention, backups are an operational safeguard rather than the customer's sole archive. You should keep independent copies of important content, configuration and data. Restore availability and recovery points depend on the selected service and the incident.
6. Suspension, abuse and discontinuance
We may urgently restrict a domain, DNS change or hosting service to contain compromise, malicious traffic, unlawful material or serious harm; comply with a registry, provider, court or regulator; or protect other customers. We will use a proportionate measure and notify the customer where lawful and practicable. If we discontinue a hosting product, we will provide reasonable notice and a migration, replacement or refund option appropriate to the circumstances. Supplier and registry changes outside our control may require a technically equivalent change.
7. Cancellation and transition
Cancellation stops future renewal but does not automatically cancel a domain licence already registered or reverse a supplier transaction. Before the service ends, you should request required exports, transfer codes, DNS records and migration support. Additional migration work is chargeable if outside the plan or order. We will not hold an eligible domain transfer solely to prevent a customer leaving. We may retain limited operational and billing records as required by law and our retention process.
